The business that accepts these unlawful bets or wagers must be proven to be in violation by proof of acceptance of these financial instruments or monies. There must also be proof that the financial instrument was accepted by someone for the explicit purpose of unlawful online gambling.

The UIGEA has attempted, although ineffectively, to completely ban any type of internet gambling such as poker, slots and other forms of betting and wagering. Although the UIGEA is practically meaningless from a legal standpoint, it does help to set forth the regulations that are needed in order to protect those who are engaged in lawful online gambling. It prohibits certain acts and activities that could cause harm to players and to online casino owners. New regulations are considered, although not necessarily put into place, regularly. The UIGEA provides those who enjoy internet poker playing and other casino type games with a safer and more enjoyable experience overall. The real worries of the online poker industry fall on the shoulders of those who operate in the industry. They must ensure that their websites are protected in many aspects. While the UIGEA has made known the policies and regulations that govern online gambling, it has not succeeded in completely banning this practice.
